Application of the general and specific terms and conditions of sale

Before placing any order (hereinafter the "Order"), the Customer must read the General Terms and Conditions of Sale (GTC) below. Matchy reserves the right to modify the general terms and conditions of sale at any time. In the event of modification, the terms and conditions in effect at the time of the order will apply.
By confirming their order by clicking the "I have read and agree to the general terms and conditions of sale" button, the Customer declares that they have read and fully accepted the General Terms and Conditions of Sale. They also acknowledge having reviewed, at the time of placing the order, the specific terms and conditions of sale displayed on the screen and declare that they accept them without reservation.

 

Information about the site and its accessibility

The Matchy website is accessible 24/7 for all internet users, except in case of interruption for maintenance, security, or force majeure. Matchy is not liable for damages resulting from the site's unavailability. The company reserves the right to modify the site for technical or commercial reasons without seeking the Client's consent, except in the case of a substantial change to the terms of service.

 

Order validity

Offers are exclusively for private individuals. Items are available while stocks last. In case of unavailability, Matchy is committed to informing and refunding the Customer within 14 days. The order process includes product selection, adding items to the cart, order confirmation, and acceptance of the Terms and Conditions. A confirmation email summarizing the order is sent to the customer.

 

Product presentation

The products are accurately described on the website, but errors may occur. Matchy does not guarantee the accuracy of the information provided by the website. Prices are displayed inclusive of all taxes for the EU and exclusive of taxes for other regions. The company reserves the right to change prices but will charge at the rate in effect at the time of the order.

 

Order refused

Matchy The company may remove a product from the site, replace/modify its content, or refuse to process an order after confirmation. The company will not be held liable for any harmful consequences of these actions, including in the event of a payment dispute or suspected fraud.

 

Price & payment terms

Prices are shown in euros, pounds sterling, Swiss francs or US dollars depending on the region. Prices include or exclude VAT as applicable.gion.Matchy reserves the right to change prices, but products will be billed at the rate in effect at the time of the order. Products are payable upon ordering, by credit card or PayPal account. Payment by check is not accepted. The products remain the property of Matchy will process your order until full payment is received. The company reserves the right to refuse an order for various reasons, and a cancellation notice may be sent in case of non-payment. The data recorded by Matchy and the means of payment constitute proof of transactions.

International deliveries and customs fees

For any order shipped outside the European Union (United Kingdom, Switzerland, United States...), customs duties or other local taxes (local VAT, import tax, customs duties, etc.) may be required upon arrival of the package at its destination.These costs remain the sole responsibility of the client, both in terms of declarations and payments to the relevant authorities or organizations of the country concerned.

If the customer refuses delivery due to non-payment of customs fees, or if the package is returned for any other reason attributable to the customer, the incurred costs (customs duties, return shipping costs, etc.) will be charged to the customer or deducted from any potential refund. If the package is detained, abandoned, or destroyed by customs or the carrier, no refund will be issued.

In the event of a voluntary return of a product delivered outside the European Union, the customer must first pay all customs duties related to the import. No return will be accepted without prior payment of these fees.

Payment security 

Payment is made exclusively by credit card on a secure banking server. Credit card information is encrypted using the SSL (Secure Socket Layer) protocol and is never transmitted unencrypted over the network. Site identification

 To place an order, the Customer can create an account or place the order as a guest. Registration on the site requires the creation of an account containing the Customer's information (the "Account").

The validation of the Client's registration on the site takes place after verification of the standard form completed by the Client, followed by a registration confirmation email.

When creating an Account, the Customer must ensure the accuracy and completeness of the data provided. They are also responsible for regularly updating their personal information. In case of an error in the recipient's contact details, Matchy declines all responsibility for the inability to deliver the products.

If the Customer has already made a purchase on the Matchy website, they can choose a password so they don't have to fill out the forms again for subsequent orders. Registered Customers are identified on the site as such. The Customer's password is strictly confidential and personal, and under no circumstances should it be disclosed or shared with anyone else. The Customer can also choose to log in using a code. A code is sent to the customer's email address each time they log in.

 

Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen days.
The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last item. To exercise the right of withdrawal, You must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax, or email). To meet the withdrawal deadline, it is sufficient that You must send your communication regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

In the event of your withdrawal from this contract, we you we will refund all payments received from you, including delivery charges (except for any additional charges arising from the fact that (you have chosen, where applicable, a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will issue the refund using the same payment method as the one you used. you will have used for the initial transaction, unless You expressly agree to a different method; in any event, this refund will not incur any costs for you. We may withhold the refund until we have received the goods or until You provided proof of shipment of the goods, the date used being that of the first of these events.

You must return or hand over the property to us without undue delay and, in any event, no later than fourteen days after you have notified us your decision to withdraw from this contract. This deadline is considered met if You return the item before the expiry of the fourteen-day period. The returned product must be in its original condition: unused, unwashed, with (ideally) all labels attached.
You will be responsible for the direct costs of returning the item.

Force Majeure

Events beyond MATCHY's control, which are not reasonably foreseeable, are considered force majeure, meaning that MATCHY is released from fulfilling contractual agreements. For example, force majeure events include government action or inaction, new legislation, conflicts, embargoes, fire or flood, sabotage, accidents, wars, natural disasters, strikes, or supplier failures to deliver. Force majeure also includes government decisions that negatively impact the market and products, such as restrictions, warnings, bans, etc.

 



Intellectual property rights 

The customer agrees not to copy or download all or part of the content of the Matchy website, except with the prior and explicit agreement of Matchy, which remains the sole holder of all associated intellectual property rights.

Matchy retains full and complete ownership of the Products sold until full payment of the price, including principal amount, fees, taxes and mandatory contributions.

 

Guarantees

The Customer benefits from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force as referred to in the article Responsibilities - Guarantees.

In the event that the Customer refuses a delivery due to an error in the contents of the delivery, or due to non-conformity or defectiveness of the products ordered, they must contact our services immediately.

The Customer has the legal period to request a credit note or to have the price refunded, in whole or in part, in accordance with the provisions of Article L.217-10 of the Consumer Code.

The consumer has a period of 2 years from the delivery of the goods to take action.

The consumer can choose between repair and replacement of the item.As specified in Article L217-9 of the Consumer Code, the seller may, however, choose a different method than that chosen by the buyer if this choice entails a cost that is clearly disproportionate to the other method.

The consumer is not required to provide proof of the existence of a lack of conformity of the goods during the 6 months following delivery. As of March 18, 2016, this period will be extended to 24 months.

The legal guarantee of conformity applies independently of any commercial guarantee that may have been purchased.

The consumer may decide to invoke the warranty against hidden defects in the item sold.

In this case, he can choose between rescinding the sale or reducing the sale price in accordance with Article 1644 of the Civil Code.
